Acceptable Use Policies

The following guidelines are designed to ensure that Eagles Nest/CrossLink users understand what uses of the Internet are acceptable. Violation of these guidelines may result in suspension or termination of Eagles Nest/CrossLink accounts.

General policy

We ask that users respect the customs and conventions of the forums in which they participate (mailing lists, newsgroups, irc, etc.). CrossLink does not monitor or referee behavior, mailings, postings, etc., that take place on our systems--nor would we want to. We will intervene when it is required to ensure the continued operation and quality of the service and, if necessary, to ensure compliance with applicable laws and regulations.

Account types and usage

Personal accounts are assumed to be for individual, family, or small office/home office (SOHO) with low to moderate use volume. Other commercial usage of accounts is permitted only within limits which are specified for each account category. Each dial-in account may have only one Internet connection session active at any given time.

Residential Unmetered/Unlimited Usage Policy

Subscribers must be sitting at their computer when they are logged on. File servers, pinging to stay connected, and unattended usage of any kind are prohibited. Usage over 240 hours per month will be considered full time usage and will be billed at the 24x7 rates with no notice. No static IP addresses or DNS services are available with this service. FLAT RATE ATTENDED* DIAL-UP ACCOUNTS "Flat Rate Attended Unlimited Use" pricing is not intended to be a dedicated line and is based upon normal usage (not for a continuous web server, or other type or server, commercial or personal, with connection maintained through automatic methods to avoid inactivity disconnect). Unlimited usage is defined as usage whereby the user is sitting at the computer using the service with keyboard commands or mouse commands. Subscribers must be sitting at their computer when they are logged on. File servers, pinging to stay connected, and unattended usage of any kind are prohibited. No static IP addresses or DNS services are available with this service. You are not allowed to log in to the service and walk away from your computer for extended lengths of time. In short, you must be in front of your computer using the Internet actively. Accounts that stay connected for prolonged periods of time (i.e.: 16 hours + per day) shall be deemed in violation of this policy and subject to one of the following actions:

1. Termination of the connection
2. Termination of the account
3. Upgrade in billing status to 24/7 status billed at $100 per month**

Such abnormal use (or effectively as such if consistently monopolizing lines) through use of automatic methods to avoid disconnection will be considered to be in substantial excess of the average for such accounts, as determined by Eagles Nest/CrossLink, and may result in a session's length reduction policy for those accounts (although not limiting overall hours of usage), and/or account termination by Eagles Nest/CrossLink. This policy helps ensure that lines are available on an equal basis for all users

*Attended Access means you have unlimited access to your account while you are in front of your computer. You do NOT have dedicated Access. You may not leave your computer connected to our service while you are away from the computer for extended periods of time. We reserve the right to remove accounts off line that are abusing this policy, and if continued abuse occurs, we will be forced to cancel the account. Subscribers must be sitting at their computer when they are logged on. File servers, pinging to stay connected, and unattended usage of any kind are prohibited. No static IP addresses or DNS services are available with this service.

**If your account is upgraded to 24/7 status due to abuse of the above policy, you will be sent one (1) notice via e-mail to your CrossLink e-mail account. Said notice shall require a response from you within a given time frame stating whether or not you wish to either curtail your usage or go to the 24/7 price plan. If there is not a response received, your account will automatically be upgraded to 24/7 status without further notice.

Post articles only to relevant newsgroups

Be thoughtful when selecting newsgroups for your postings. When crossposting to multiple groups, think twice before posting to more than two or three groups. "Spamming" is the term used to describe bulk posting to many newsgroups. Spamming is not appreciated by the participants of these groups and will result in suspension of your account.

Inappropriate commercial use

The Internet, like most places, has its own set of customs. Internet users don't take kindly to unsolicited commercial e-mail or advertising that is more hype than information. Many newsgroups have their own individual guidelines regarding commercial postings. When in doubt, monitor a newsgroup for several weeks, or ask a regular poster how the readership responds to commercial postings. Responding to an explicit request for information is usually OK, but consider sending mail directly to the requester instead of posting the response to the newsgroup.

Copyright and compliance with laws

When sharing information on the Internet, respect the intellectual properties of others. Do not post text from publications verbatim without permission. Do not digitize and distribute photographs from magazines, books or other sources. Do not make copyrighted software available on the Internet. When quoting from copyrighted material, include a reference so others can locate the complete work. Excerpts of private e-mail messages you may receive should not be posted to a public forum without the author's permission. CrossLink will take action against copyright infringement activities.

Be aware that local and federal laws prohibit the dissemination of certain information in electronic form. Since the Internet is a global system, some available materials may not be in compliance with United States laws. Eagles Nest/CrossLink expects its users to operate in compliance with all applicable laws and will take action against violations. Eagles Nest/CrossLink does not censor or otherwise review materials available to Internet users; since Eagles Nest/CrossLink cannot control the information made available on the Internet, each individual user must determine what information he or she wishes to utilize. In addition, use of the Internet by minors should be under the supervision of an adult. Eagles Nest/CrossLink is not responsible for information obtained by users through their accounts.

Chain letters and pyramid schemes

Chain letters are annoying and pyramid schemes (chain letters with money) are illegal. Do not promote these activities on Eagles Nest/CrossLink or the Internet in general.

Hacking

Eagles Nest/CrossLink forbids attempts to breach security in our system or in other systems. If you suspect a problem with our services (or others), we would appreciate a friendly e-mail message from your own account. Severe penalties may be imposed for unauthorized use of computer systems.

Fraudulent or abusive behavior - Spam

Fraudulent behavior such as, but not limited to, the forging of newsgroup postings or electronic mail is forbidden. Forging is the unauthorized use of an account or user id other than your own. Harassing or abusing others  through e-mail or news is also prohibited. If you are at the receiving end of  this behavior, please contact Eagles Nest/CrossLink immediately. Spam, under and circumstances is strictly prohibited and will result in the termination of your account immediately.

Discontinuation of Services by Customer - Terms and Conditions

Subscriber may terminate this agreement at any time to be effective as of the end of a calendar month. Cancellation must be in writing and sent to Eagles Nest, Ltd's mailing address, faxed or emailed to us on or before the 20th of the month in order to have cancellation effective for that month. Accounts for which a termination is requested after the 20th day of the month will be scheduled for termination effective the end of the following month and the subscriber shall be liable for all charges for that month.

Termination of Service by Provider - Terms and Conditions

CrossLink/Eagles Nest may terminate this agreement in the event that the subscriber does not comply with our Acceptable Use Guidelines. In the event any such termination occurs, subscriber will receive a pro-rata refund of any prepaid fees calculated as if the subscriber had terminated the agreement in accordance with the provisions above. Termination for non payment of fees shall result in legal action being taken by our corporate attorneys to recuperate all funds owed, and in some cases as applicable by local laws, the customer can be held liable for all attorneys fees. Inappropriate or illegal charge backs instituted by the customer to falsely obtain money back to their credit cards shall result in a $35 service fee being accessed to the account along with all applicable collections fees.
