Recommended System Requirements:

Due to the fact that Microsoft and the other major software developers are not supporting or writing new software applications for Windows 3.11 and below, we do not recommend you use this OS and we do not support it any longer. We can put you on line with older software, however, we cannot promise you you will have optimal performance or be able to install and enjoy the latest Internet software. We recommend the following as minimum standards for use when accessing the Internet.

This agreement is made between the CrossLink Internet Services, Inc., Eagles Nest, Ltd., Inc. and the individual or organization applying for Internet access service (subscriber). Whereas subscriber wants to obtain access to the Internet through Eagles Nest, Ltd. and CrossLink Internet access service and Eagles Nest, Ltd. and CrossLink wish to provide such service, the following terms and conditions will be applicable. Use of the Service will be construed as an acceptance of the terms and conditions of this agreement.

For those subscribers who wish to utilize a credit card or preauthorized debit transaction as the method of payment, the parties agree as follows:

• Subscriber understands and hereby agrees that CrossLink service charges will be debited on a periodic basis to the indicated credit card or bank account as indicated on the Customer Order and Information Form on a periodic basis or to a replacement credit card or bank account as provided by the subscriber.

For all subscribers, the following terms and conditions apply:

• The duration of this agreement will be from the initial date of availability of CrossLink service to the subscriber until this agreement is canceled or terminated by either party under the provisions of this agreement.
• Customer is responsible for any and all long distance charges if any are incurred. It is the customers responsibility to make sure the local dial up number for their particular area is a local call for them. It is highly recommended that you call your local phone company and verify that the number for your area is in fact a local, no toll call for you.
• Subscriber may terminate this agreement at any time to be effective as of the end of a calendar month. Cancellation must be in writing and sent to Eagles Nest, Ltd's mailing address, faxed or emailed to us on or before the 20th of the month in order to have cancellation effective for that month. Accounts for which a termination is requested after the 20th day of the month will be scheduled for termination effective the end of the following month and the subscriber shall be liable for all charges for that month.
• CrossLink/Eagles Nest may terminate this agreement in the event that the subscriber does not comply with our Acceptable Use Guidelines. In the event any such termination occurs, subscriber will receive a pro-rata refund of any prepaid fees calculated as if the subscriber had terminated the agreement in accordance with the provisions above.
• CrossLink/Eagles Nest, Ltd. will provide at least thirty (30) days notice of any material change in the terms and conditions of the agreement. Notice will consist of changing the information on both Eagles Nest's and CrossLink's web site and subscriber Email or postal mail notification. If this agreement is terminated, subscriber will not be responsible for any additional Internet access charges beyond the date of effective termination. However, if discounts were provided on Internet access charges due to a term agreement, the fees due and payable will be calculated to reflect the non-discounted rates as applied to the period of time the service was actually provided.

Direct Debit Information (Note: all accounts will be debited on or about the last day of each month for the amount of recurring fee for the following month.) Please note that Direct Debit transactions may take up to 45 days to get setup. Therefore, you should make certain that you deduct the applicable amount of money from your account on or about the 28th of each month to insure that you have the correct amount of money in your account. A $35 processing fee will be applied to any delinquent accounts that are left unpaid. If left unpaid for a period of longer than 45 days, the account will be turned over to the collection agency for further action. Credit Card accounts will be debited on or about the 28th day of each month for the recurring amount. It is your responsibility to make sure you have the funds available in your card account to cover these charges.

I hereby apply for Eagles Nest/CrossLink Internet Services as indicated below. I agree to comply with Eagles Nest/CrossLink's Acceptable Use Guidelines of which I have reviewed a copy. If credit card information is provided herein, I hereby agree to credit card billing in accordance with the applicable terms and conditions. I further agree that if I chose to discontinue my service, there is a written notice required in order to do so. Said notice must be in writing to either Eagles Nest, Ltd. either by fax, U. S. Mail or by Email. Phone call requests for termination of an account will not be accepted for any reason. Notice of cancellation must be given in writing prior to the 20th day of the month to avoid billing for the next month. All charges to credit cards and direct billing transactions are made by us on or about the 28th of each month. It is the subscribers responsibility to make certain that funds are available at that time. I may modify the services ordered under provision of this agreement and change the billing and/or credit card information by providing appropriate written notice to Eagles Nest, Ltd.
